Terms of Service

1. Acceptance of Terms
By using Time to Moto ("the Service"), you agree to these terms. If you do not agree, do not use the Service. These terms constitute a binding agreement between you and Time to Moto.
2. The Service
Time to Moto is a motorcycle app providing route planning, weather information, navigation, ride recording, safety features, garage management, and AI assistance. The Service is provided as is and is intended as a tool to assist riders, not as a replacement for rider judgment. Always ride according to road conditions and applicable traffic laws. Do not interact with the app while operating your motorcycle.
3. Who Can Use the Service
You must be 18 years of age or older to use the Service. If you are under 18, you must have the permission of a parent or guardian who agrees to these terms on your behalf before using the Service.
4. Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account and all activity that occurs under your account. One account per person. Accounts are shared between the iOS app and the website. You may not transfer your account or password to any third party.
5. Subscriptions
Time to Moto is free during the beta period. Subscription pricing will be announced before public launch and managed through the Apple App Store.
6. Safety Disclaimer
Time to Moto provides information to assist your riding decisions but does not guarantee the accuracy of weather data, route conditions, road conditions, or safety features. Always ride responsibly. Crash detection and emergency contact features are best-effort and should not be relied upon as your sole safety measure.
The information provided by the Service is not intended to replace information presented on the road. If road signs, traffic signals, police instructions, or road conditions instruct differently than the Service, follow the road.
ALWAYS RIDE ACCORDING TO ROAD CONDITIONS AND APPLICABLE TRAFFIC LAWS. DO NOT INTERACT WITH THE APP WHILE OPERATING YOUR MOTORCYCLE. FAILURE TO PAY FULL ATTENTION TO THE ROAD AND TRAFFIC AROUND YOU MAY RESULT IN DEATH, SERIOUS INJURY, AND PROPERTY DAMAGE. YOU ASSUME FULL RESPONSIBILITY FOR ANY DEATHS, INJURIES, AND PROPERTY DAMAGE THAT OCCUR WHILE USING THE SERVICE.
7. Crash Detection
Crash detection is available only during an active ride when you have enabled it from the pre-ride checklist. It is not active at any other time.
The crash detection feature uses your phone's accelerometer to monitor for patterns consistent with a crash. While we have designed this feature carefully, we cannot guarantee it will activate in every crash scenario or that it will not activate in non-crash scenarios. Variables including device damage, network coverage, and the nature of the incident can affect its performance.
If crash detection activates and the countdown is not cancelled, the Service will attempt to send alerts to your selected emergency contacts via SMS and email. These alerts require a cell connection to send. We cannot guarantee successful delivery in all circumstances, including areas with no signal.
If you allow another person to use your phone during an active ride with crash detection enabled, their activity may trigger alerts to your emergency contacts. Time to Moto is not responsible for any consequences arising from this situation. Always disable crash detection or end your active ride before allowing someone else to use your device.
Crash detection should not be your sole safety measure. Always let people know your planned route and expected return time when riding alone.
8. AI Features
Scout AI provides information based on available data and AI models. Responses may not always be accurate. Always verify critical information such as tire pressures or torque specs against your motorcycle's owner's manual before riding.
9. Internet Connection
Most features of the Service require an internet connection, including route planning, weather, navigation map tiles, Scout, and Live Share. Crash detection and ride recording work offline using your phone's GPS and accelerometer. Any data charges incurred through your use of the Service are your sole responsibility.
10. Third Party Services
The Service relies on third party service providers for mapping and navigation, AI and machine learning, weather, safety alert delivery, and analytics. These providers are independent of Time to Moto. We are not responsible for the accuracy, availability, or performance of any third party service. Your use of features that depend on these services is subject to their availability.
11. Data
Your ride data, GPS paths, and sensor data recorded through the Service are stored in your account and are not shared publicly. Anonymized, aggregated data may be used to improve the Service. Your personal data is handled in accordance with our Privacy Policy.
12. Limitation of Liability
TIME TO MOTO AND ITS OWNER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR OTHER DAMAGES OR LOSSES, INCLUDING LOSS OF DATA, LOSS OF PROFIT, PROPERTY DAMAGE, OR PERSONAL INJURY, ARISING FROM OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, ANY FAILURE OR ERROR IN THE SERVICE, YOUR RELIANCE ON ROUTE DATA, WEATHER INFORMATION, ROAD CONDITIONS, CRASH DETECTION, EMERGENCY ALERTS, OR AI-GENERATED CONTENT, OR ANY COMMUNICATION WITH OR THROUGH THE SERVICE. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SERVICE IS TO STOP USING IT.
13. Warranty Disclaimer
THE SERVICE IS PROVIDED AS IS AND AS AVAILABLE WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, SECURITY, OR NON-INFRINGEMENT. TIME TO MOTO DOES NOT WARRANT THAT THE SERVICE WILL OPERATE WITHOUT INTERRUPTION, ERRORS, OR HARMFUL COMPONENTS, OR THAT IT WILL ALWAYS BE AVAILABLE.
14. Indemnification
You agree to indemnify and hold harmless Time to Moto and its owner from any claims, damages, losses, expenses, and legal fees arising from your violation of these terms or your use of the Service.
15. Intellectual Property
All rights in and to the Time to Moto app, website, brand, and content are the exclusive property of Time to Moto. You may not copy, modify, distribute, reverse engineer, decompile, or otherwise exploit any part of the Service without prior written consent. The Time to Moto name, logo, and trade dress are protected and may not be used without prior written consent.
16. Use Restrictions
You may use the Service for personal, non-commercial purposes only. You may not:
- Offer, resell, rent, lease, or sublicense the Service to any third party
- Scrape, data mine, harvest, or index any data from the Service
- Copy or exploit any content from the Service for commercial purposes
- Interfere with or disrupt the operation of the Service or its servers
- Transmit any virus, malware, or harmful code through or to the Service
- Use the Service for any unlawful or unauthorized purpose
- Attempt to circumvent any security or access controls in the Service
17. Apple
If you use the Service on an Apple device, you acknowledge and agree that:
- Apple Inc. bears no duties or obligations to you under these terms, including maintenance, support, or warranty obligations
- You have no claims against Apple related to the Service, including claims related to intellectual property, liability, consumer protection, or regulatory compliance
- Apple and its subsidiaries are third party beneficiaries of these terms and have the right to enforce them against you upon your acceptance
18. Modifications to the Service
Time to Moto may modify, update, suspend, or discontinue the Service or any part of it at any time without prior notice. You will have no claim against Time to Moto for any such changes.
19. Governing Law
These terms are governed by the laws of the State of Texas without regard to conflict of law principles. Any disputes arising from these terms or your use of the Service shall be resolved exclusively in the courts of Travis County, Texas.
20. Limitations on Claims
Any claim or cause of action arising from your use of the Service must be filed within one year of the date you became aware of the claim. Claims not filed within this period are permanently barred.
21. Assignment of Rights
You may not assign or transfer your rights under these terms without prior written consent from Time to Moto. Time to Moto may assign its rights to a third party at its sole discretion provided the third party assumes Time to Moto's obligations to you.
22. No Legal Relationship
These terms do not create any partnership, joint venture, employer-employee, agency, or franchise relationship between you and Time to Moto.
23. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
24. Termination
You may delete your account at any time. Time to Moto may suspend or terminate your access to the Service at any time and for any reason at its sole discretion.
25. Changes to Terms
We may update these terms at any time. Continued use of the Service after changes are posted means you accept the updated terms. We will notify you of significant changes via email.
